Terms & Conditions

for Cyan Creative (PTY) LTD 

Ownership & Intellectual Property

All content, design frameworks, and “Communication Design” assets on this website are the exclusive property of Cyan Creative (PTY) Ltd.

  • Client Work: Per our standard agreements, intellectual property rights in final work products are transferred to the client only upon receipt of full payment.
  • Agency Rights: We reserve the right to use non-confidential samples of completed work for our agency portfolio and marketing purposes.

Service Engagement & Payments

By engaging our services, you agree to the financial terms outlined in your specific project agreement:

  • Invoicing: Monthly services are typically invoiced on the 1st of each month and are due within 7 calendar days.
  • Late Fees: A late fee of 2% per month may be applied to outstanding balances.
  • Suspension: We reserve the right to suspend all active services (including Paid Ads and Social Media Management) if invoices remain unpaid for more than 14 calendar days.

Termination Policy

Consistency is the heartbeat of trust, but we understand that business needs change:

  • Convenience: Either party may terminate a recurring service agreement by providing a minimum of 30 calendar days’ written notice.
  • Cause: Immediate termination is permitted in the event of a material breach that remains unremedied for 14 calendar days.

Jurisdiction

These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the South African courts.
